Terms of Service - Langwish

These Terms of Service (“Terms”) govern your use of the Langwish mobile application (“App”) and related services offered by us (“we”, “us”, “our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Who we are

Langwish is a language-learning application. Features may include vocabulary practice, quizzes, progress tracking, optional AI-assisted vocabulary generation, focus / screen-time related tools where supported by your device, and account-based sync across your devices.

2. Eligibility and your account

  • You must be able to enter a binding agreement in your jurisdiction. If you are under the age of digital consent in your country (often 16 in the EU, unless your member state sets a lower age with conditions), you may only use the App with permission of a parent or guardian.
  • You are responsible for the accuracy of information you provide and for keeping your login credentials and device secure.
  • You may delete your account from within the App where this is offered. Certain records (for example, abuse-prevention data tied to your email) may be retained where permitted by law and as described in our Privacy Policy.

3. License to use the App

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App in line with these Terms and with the rules of the app store from which you obtained it (e.g. Apple App Store).

You must not:

  • copy, modify, or create derivative works of the App except as allowed by law;
  • reverse engineer, decompile, or attempt to extract source code except where mandatory law allows;
  • use the App to violate law or third-party rights;
  • attempt to disrupt, overload, or circumvent security or usage limits;
  • use automated means to scrape or abuse the service.

4. Subscriptions and payments

Paid features may be offered via in-app purchases processed by Apple (or another platform you use). Payment, billing, refunds, and subscription management are governed by Apple’s (or the relevant platform’s) terms and policies. To the extent allowed by law, we do not process your full payment card data in the App.

Free trials or promotional limits may apply. We may record usage or identifiers (such as email hashed or stored in line with our Privacy Policy) to prevent misuse of trials or promotional offers.

5. AI-generated content

Parts of the App may generate or suggest vocabulary or learning content using automated / AI systems. AI output can be inaccurate, incomplete, or inappropriate. You use such content at your own risk. We do not guarantee correctness of translations, cultural suitability, or fitness for exams or professional use. Do not rely on the App as the sole source of language education.

6. Third-party services

The App may rely on third-party services (e.g. authentication, cloud hosting, analytics, feedback tools, AI providers). Their use is subject to their terms and privacy notices. We are not responsible for third-party services we do not control.

7. Screen Time, notifications, and device permissions

Where you choose to enable them, the App may use Screen Time, Family Controls, notifications, or other iOS features. You control these in Settings on your device. We do not guarantee uninterrupted or error-free operation of OS-level features.

8. Intellectual property

The App, its branding, and our content are protected by intellectual property laws. Except for your own content and rights you have in data you submit, you obtain no ownership rights in our materials.

You grant us a limited licence to host, process, and display content you submit only as needed to run the service (see our Privacy Policy).

9. Disclaimer of warranties

To the maximum extent permitted by applicable law, the App and all content are provided “as is” and “as available”. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranties arising from course of dealing or usage.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law (including, where applicable, consumer rights under EU/EEA or Dutch law).

10. Limitation of liability

To the extent permitted by law:

  • we are not liable for indirect, consequential, special, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the App;
  • our total liability for claims arising from the App in any twelve-month period is limited to the greater of (a) one hundred euros (€100) or (b) the amount you paid us for the App or subscription in that period (excluding amounts paid to Apple or other platforms).

These limits do not apply where prohibited by mandatory consumer law.

11. Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless against claims arising from your misuse of the App, your violation of these Terms, or your violation of third-party rights.

12. Changes

We may update these Terms. We will post the updated version and adjust the “Last updated” date. If changes are material, we will use reasonable means to notify you (e.g. in-app notice). Continued use after the effective date may constitute acceptance. If you do not agree, stop using the App and, where available, delete your account.

13. Suspension and termination

We may suspend or terminate access if we reasonably believe you breached these Terms, pose a security risk, or where required by law. You may stop using the App at any time. Provisions that by nature should survive (e.g. liability limits, governing law) will survive termination.

14. Governing law and disputes

Unless mandatory consumer law in your country gives you the right to choose differently:

  • these Terms are governed by the laws of the Netherlands;
  • courts in the Netherlands have jurisdiction, subject to mandatory rights you may have as a consumer in your country of residence within the EU/EEA or UK to bring proceedings in your home jurisdiction.
